Terms of Service

These Terms of Service ("Terms") govern your use of https://www.devcomdigital.com and the tools, downloads and services provided by Devcom Digital Marketing Services ("we", "us") (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service for an organisation, you confirm that you have authority to accept these Terms on its behalf.
1. Your account
- You must give accurate information and keep it up to date.
- You are responsible for keeping your password safe and for everything that happens under your account.
- You must be at least 16 years old, or the age of majority where you live if that is higher.
- Tell us straight away at support@devcomdigital.com if you think someone has accessed your account without permission.
2. Subscriptions and billing
- Tools in the suite need an active paid subscription. We bill through PayPal in advance for each billing period (monthly or yearly), and the subscription renews automatically until you cancel.
- Prices are shown on our pricing page and may not include taxes that apply where you live.
- If we offer a free trial, you'll be charged when it ends unless you cancel before then.
- We may change prices. We'll give you at least 30 days' notice before a change affects your subscription, and you can cancel before it takes effect.
- If a payment fails, we may suspend access until the payment goes through.
3. Cancellation
You can cancel at any time from your dashboard. Cancelling stops future billing, and you keep access until the end of the period you've already paid for. Refunds are covered by our Refund Policy.
4. License keys and tools
- When your subscription is active, we issue you a personal license key. It is for you (or your organisation's authorised users under your account) only. You may not share, sell, publish or transfer it.
- While your subscription is active, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the tools for your own business and client work.
- When your subscription ends, your license key is deactivated, and you must stop using any tools that require it.
- Some tools are labelled "In development". They may change, be incomplete, or never be released.
- We may add, change or retire tools over time. If we remove a significant part of the suite, we'll give you reasonable notice.
5. Acceptable use
You agree not to:
- share your license key or account, or get around licensing, usage limits or access controls;
- reverse engineer, decompile or resell the tools, except where the law allows it;
- use the Service for anything illegal, fraudulent, infringing, or for spam;
- attempt to disrupt, overload or gain unauthorised access to the Service or other users' data;
- upload malware or content you don't have the right to share.
We may suspend or end accounts that break these rules.
6. Your content
You keep ownership of the content you upload or submit (messages, files, requests). You give us the permission we need to host and process it in order to run the Service. Our Privacy Policy explains how we handle personal data.
7. Custom work and quotations
Quotations for custom work may be drafted with the help of AI and are estimates only until we confirm them in writing. Any custom project is governed by the terms agreed for that project.
8. Our intellectual property
The Service, the tools and all related software, content and branding belong to Devcom Digital Marketing Services or its licensors. These Terms do not transfer any ownership to you.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, or that it will achieve any particular marketing result.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
You can stop using the Service and cancel your subscription at any time. You can also delete your account from your profile page. Deleting it cancels any subscription immediately and ends your access straight away, including any time already paid for. We may suspend or end your access if you seriously or repeatedly break these Terms, or if the law requires us to. Sections 6–10 and 12 continue to apply after termination.
12. Governing law
These Terms are governed by the laws of the Republic of the Philippines. The courts of the Philippines have jurisdiction over any dispute arising from them. If you are a consumer, you also keep any protection that the mandatory laws of your own country give you.
13. Changes to these Terms
We may update these Terms. If we make significant changes, we'll notify you by email or on the site at least 30 days before they take effect. If you keep using the Service after that, you accept the updated Terms.
